  1. YOU SHOULD CAREFULLY READ THE FOLLOWING END USER LICENSE 
  2. AGREEMENT BEFORE INSTALLING THIS SOFTWARE PROGRAM. 
  3. BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE 
  4. PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. 
  5. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, PROMPTLY 
  6. RETURN THE UNUSED SOFTWARE PROGRAM TO THE PLACE FROM WHICH YOU 
  7. OBTAINED IT FOR A FULL REFUND.

  9. SINGLE MACHINE LICENSES
  10.  
  11. WiseDimensions grants you a license to use one copy of this
  12. software on any one hardware product.
  13.  
  14. SITE LICENSES
  15.  
  16. WiseDimensions grants you a license to use one copy of this
  17. software on any one hardware product for as many
  18. licenses as you purchase.
  19.  
  20. 30-DAY TRIAL LICENSES
  21.  
  22. WiseDimensions grants you a license to use one copy of this
  23. software on any one hardware product for an evaluation
  24. period of 30 days, after which time you must pay
  25. for the software or uninstall it.
  26.  
  27. "Use" means storing, loading, installing, executing or displaying
  28. the SOFTWARE. You may not modify the SOFTWARE or disable
  29. any licensing or control features of the SOFTWARE except as an
  30. intended part of the SOFTWARE's programming features.
  31.  
  32. OWNERSHIP.
  33. The SOFTWARE is owned and copyrighted by WiseDimensions. 
  34. Your license confers no title or ownership in the SOFTWARE 
  35. and should not be construed as a sale of any right in the
  36. SOFTWARE. 
  37.  
  38. COPYRIGHT.
  39. The SOFTWARE is protected by United States copyright law 
  40. and international treaty provisions. You acknowledge that no 
  41. title to the intellectual property in the SOFTWARE is transferred 
  42. to you. You further acknowledge that title and full ownership 
  43. rights to the SOFTWARE will remain the exclusive property of
  44. WiseDimensions and you will not acquire any rights to the 
  45. SOFTWARE except as expressly set forth in this license. You 
  46. agree that any copies of the SOFTWARE will contain the same 
  47. proprietary notices which appear on and in the SOFTWARE. 
  48.  
  49. UNAUTHORIZED USE.
  50. You may not use, copy, rent, lease, sell, modify, decompile,
  51. disassemble, otherwise reverse engineer, or transfer the
  52. SOFTWARE except as provided in this agreement. Any such
  53. unauthorized use shall result in immediate and automatic
  54. termination of this license.
  55.  
  56. U.S. GOVERNMENT INFORMATION.
  57. Use, duplication, or disclosure by the
  58. U.S. Government of the computer software and
  59. documentation in this package shall be subject to restrictions as
  60. set forth in subparagraph (c)(1)(ii) of the Rights in Technical
  61. Data and Computer Software clause at DFARS 252.277-7013
  62. (Oct 1988) and FAR 52.227-19 (Jun 1987). The Contractor is
  63. WiseDimensions, Arvada CO.
  64.  
  65. LIMITED WARRANTY.
  66. THIS SOFTWARE IS PROVIDED ON AN "AS IS" BASIS.
  67. WISEDIMENSIONS DISCLAIMS ALL WARRANTIES
  68. RELATING TO THIS SOFTWARE, WHETHER EXPRESSED
  69. OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY
  70. IMPLIED WARRANTIES OF MERCHANTABILITY OR
  71. FITNESS FOR A PARTICULAR PURPOSE. NEITHER
  72. WISEDIMENSIONS NOR ANYONE ELSE WHO HAS BEEN
  73. INVOLVED IN THE CREATION, PRODUCTION, OR
  74. DELIVERY OF THIS SOFTWARE SHALL BE LIABLE FOR
  75. ANY INDIRECT, CONSEQUENTIAL, OR INCIDENTAL
  76. DAMAGES ARISING OUT OF THE USE OR INABILITY TO
  77. USE SUCH SOFTWARE, EVEN IF WISEDIMENSIONS HAS
  78. BEEN ADVISED OF THE POSSIBILITY OF SUCH
  79. DAMAGES OR CLAIMS. THE PERSON USING THE
  80. SOFTWARE BEARS ALL RISK AS TO THE QUALITY AND
  81. PERFORMANCE OF THE SOFTWARE.

  83. SOME JURISDICTIONS DO NOT ALLOW LIMITATION OR 
  84. EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL 
  85. DAMAGES, SO THE ABOVE LIMITATIONS OR
  86. EXCLUSION MAY NOT APPLY TO YOU TO THE EXTENT 
  87. THAT LIABILITY IS BY LAW INCAPABLE OF
  88. EXCLUSION OR RESTRICTION.

  90. IN NO EVENT SHALL ANY THEORY OF LIABILITY
  91. EXCEED THE LICENSE FEE PAID TO WISEDIMENSIONS. 
  92.  
  93. SEVERABILITY.
  94. In the event of invalidity of any provision of this license, the 
  95. parties agree that such invalidity shall not affect the validity of
  96. the remaining portions of this license. 
  97.  
  98. LIABILITY.
  99. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO
  100. EVENT SHALL WISEDIMENSIONS OR ITS SUPPLIERS BE
  101. LIABLE TO YOU FOR ANY CONSEQUENTIAL, SPECIAL,
  102. INCIDENTAL OR INDIRECT DAMAGES OF ANY KIND 
  103. ARISING OUT OF THE DELIVERY, PERFORMANCE OR 
  104. USE OF THE SOFTWARE, EVEN IF WISEDIMENSIONS HAS
  105. BEEN ADVISED OF THE POSSIBILITY OF SUCH 
  106. DAMAGES. IN NO EVENT WILL WISEDIMENSIONS 
  107. LIABILITY FOR ANY CLAIM, WHETHER IN CONTRACT,
  108. TORT OR ANY OTHER THEORY OF LIABILITY, EXCEED 
  109. THE LICENSE FEE PAID BY YOU, IF ANY. 
  110.  
  111. GOVERNING LAW.
  112. This agreement shall be governed by the laws of the State of 
  113. Colorado excluding the application of its conflicts of law rules 
  114. and shall inure to the benefit of WiseDimensions and any successors, 
  115. administrators, heirs and assigns. Any action or proceeding
  116. brought by either party against the other arising out of or related 
  117. to this agreement shall be brought only in a STATE or 
  118. FEDERAL COURT of competent jurisdiction located in 
  119. Jefferson County, Colorado. The parties hereby agree to the
  120. jurisdiction of said courts. The United Nations
  121. Convention on Contracts for the International Sale of Goods is 
  122. specifically disclaimed. 
  123.  
  124. INSPECTION AND TESTING.
  125. You agree and acknowledge that you will thoroughly inspect and 
  126. test the SOFTWARE for all of your purposes upon 
  127. commencement of your use. Any suit or other legal action, claim 
  128. or any arbitration relating in any way to this agreement or 
  129. software covered by it must be officially filed or officially
  130. commenced no later than three months (90 days) after your first 
  131. use of the software. 
  132.  
  133. ENTIRE AGREEMENT. 
  134. This is the entire agreement between you and WiseDimensions which 
  135. supersedes any prior agreement or understanding, whether 
  136. written or oral, relating to the subject matter of this license.
  137.  
  138. RESERVED RIGHTS. 
  139. All rights not expressly granted here are reserved to
  140. WiseDimensions.
